This Privacy Policy ("Privacy Policy") describes how Sumble, Inc. as a controller ("Sumble", "we", "us," "our") collects, uses, and discloses information from and about you when you use our websites on which we link to this Privacy Policy (including https://sumble.com) (each a "Site" and together the "Sites"), and any of our applications, services, tools and features, or otherwise interact with us (collectively, together with any interactions, the "Services"), and otherwise.

Please read this Privacy Policy carefully. By using, accessing, or downloading any of the Services, including by visiting our Sites, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use any of the Services.

Undefined capitalized terms shall have the meaning set forth in our Terms of Service.

1. UPDATING THIS PRIVACY POLICY

We may modify this Privacy Policy from time to time, in which case we will update the "Last Revised" date at the top of this Privacy Policy. If we make material changes to the Privacy Policy, we will notify you as required by applicable law. Changes to this Privacy Policy are effective when they are posted on this page or as otherwise notified to you. Your continued use of the Services after we publish changes to this Privacy Policy constitutes your acceptance of the updated Privacy Policy. If you do not agree to any updates to this Privacy Policy, please do not access or continue to use the Services.

Information You Provide to Us Directly

We collect information that you provide to us, including any information provided when you interact with us in any way via the Services or via email or phone, in person, or otherwise. Some features of the Services may require you to directly enter certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you provide to us may include, without limitation:

  • Employment information (e.g., your company or organization name; your job title).
  • Commercial information (e.g., information associated with your purchases on the Services).
  • Payment information, which is collected and processed by our third-party payment processor on our behalf (provided that we may collect limited information, such as the expiration date and CVV number of your card).

  • Your usage of the Services, including the companies and technologies for which you search.
  • Any other information you choose to provide to us or include in communications with us, such as, for example, when emailing us or submitting a form through the Services.

Information We Collect Automatically

When you interact with the Services or when you interact with our ads or content anywhere online, we and third parties may automatically collect certain information about your interaction with the Services, including information about your browser, device, such as device identifiers, cookie identifiers, other online or device identifiers, device type, IP address, browser type, date and time stamps (such as the date and time you first accessed the Services), Site pages visited and navigation through those pages, operating system, log data, when and how much you use the Services, and other information regarding your interaction with the Services. Some of this information is collected using cookies and other similar technologies. Information We Collect from Other Sources

We may obtain information about you from outside sources, including, without limitation, your employer (for purposes of creating and managing accounts with the Services), third-party licensors, such as consumer marketing databases, other data enrichment companies, or app integrations such as Slack. This information may include, without limitation, your name, email address, professional information such as your job title and company, and information about you (such as the foregoing) that is publicly viewable on professional social networks.

We may collect information about your interactions with us on third-party platforms, including our social media accounts. This information includes, but is not limited to, your likes, shares, and other interactions with our content, and your social media handle. We may also collect information about you from other sources, in accordance with applicable law. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices.

The Services may also display, include or make available Third Party Materials. For clarity, this Privacy Policy does not apply to Third Party Materials.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for various purposes, depending on the type of information and the way you interact with the Services, including:

  • To provide, manage, and improve the Services;
  • To administer your account, including to process your registration and verify your information;
  • To communicate with you about your use of our Services, including to respond to your inquiries and for other customer service purposes, which may include communicating with you via email;

We may aggregate and/or de-identify information collected through the Services. We may use and disclose aggregated or de-identified information for any purpose.

Some jurisdictions require us to state our "legal basis" for using your information. In applicable jurisdictions, we rely on the following legal bases for using your information as set out in this Privacy Policy, as relevant given the type of information and the context and purpose for using it:

  • Where we need to perform the contract we are about to enter into or have entered into with you for the Services;
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
  • Where we need to comply with a legal or regulatory obligation; or

In certain circumstances, Sumble may disclose your information as follows:

  • We may disclose your information to service providers or other vendors and professional advisors that provide services to us, such as technical infrastructure, analytics, security, advertising, customer service, communications, data storage, consulting, auditing, accounting, or legal services.
  • In accordance with our agreements, we may provide access to your information through our Services to our customers, which may include your employment information, such as contact details, company/organization name, and title.
  • We may disclose your information to our affiliates or otherwise within our corporate group.
  • We may disclose your employment-related information (such as your name, work email address, and Sumble usage) to other individuals at the company you work for.
  • We may allow third-party advertising technologies (e.g., ad networks and ad servers) to use cookies and similar technologies on the Services to deliver relevant and targeted content and advertising to you on other websites you visit and applications you use, as explained further in the "Online Analytics and Advertising" section below.
  • We may disclose your information if we believe in good faith that it is necessary or appropriate to comply with applicable law or any obligations thereunder, including cooperation with law enforcement, judicial orders, and regulatory inquiries; to establish or exercise our legal rights; to defend against legal claims; to seek legal representation or advice; and to enforce our legal terms, agreements, and policies.
  • We may disclose your information in connection with, or to take steps in preparation for, an asset sale, merger, bankruptcy, or other business transaction.
  • We may disclose your information if we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; and to protect and defend the rights, property or safety of Sumble, its users, its employees, or others.
  • We may disclose your information when you request us to disclose certain information with third parties (such as through your use of social media widgets or login integrations), or when you consent to our disclosure of your information.
  • We may also disclose your information as otherwise permitted or required by law.

5. YOUR CHOICES AND RIGHTS

Marketing Emails

You may use the unsubscribe link found in emails we send to opt out of receiving future marketing emails. Note that it may take up to 10 days for your preferences to take effect. If you opt out of marketing communications, you may continue to receive certain non-promotional and service-related communications about us and our Services, such as communications regarding the status of your account, your purchases or orders, security-related matters, or updates to our legal terms, including this Privacy Policy. Opting out of marketing communications will not halt these and any other non-promotional communications.

Cookies and Other Tracking Technologies

We and our vendors may collect information using cookies and other similar technologies that track, measure, and analyze the behaviors and usage patterns on our Services. Cookies are small data files that can be stored on your browser and device. We use cookies for a variety of purposes, including analytics and advertising purposes, to recognize you when you return to the Services, to deliver certain features of the Services, to help us understand how users engage with the Services, and to improve your experience.

"Do Not Track" Signals

"Do Not Track" is a setting available in some web browsers. Like many websites, our Sites do not recognize or respond to "Do Not Track" signals received from browsers. Rights Regarding Your Information

Depending on your jurisdiction, you may have the right, in accordance with applicable data protection laws, to make requests related to your "personal information" or "personal data" (as such terms are defined under applicable law, and collectively referred to in this section as "personal information"). Specifically, you may have the right to ask us to:

  • Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties to which we disclose personal information;
  • Provide you access to and/or a copy of certain personal information we hold about you;
  • Correct or update personal information we hold about you;
  • Delete certain personal information we have about you;
  • Restrict or object to certain uses of your information;

Please note that certain information may be exempt from such requests under applicable law. For example, we need certain information in order to provide the Services to you or comply with applicable law. We may take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name and email address. If we are unable to verify your identity, we may be unable to respond to your requests.

You may be able to designate an authorized agent to make requests on your behalf. For an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent's request as permitted by applicable law.

Depending on applicable law, you may have the right to lodge a complaint with a supervisory authority.

Notice of right to Opt Out of Sales of Personal Information and Processing/Sharing of Personal Information for Targeted Advertising Purposes. Depending on your jurisdiction, you may also have the right to opt out of "sales" of your personal information and "sharing/processing of your information for targeted advertising."

As explained in the "How We Disclose Your Information" section above and the "Online Analytics and Advertising" section below, we may provide personal information to third-party advertising providers for targeted advertising purposes or use related analytics partners to assist us in analyzing use of our Services and our user/customer base. We may also provide personal information to our customers to provide you with information that is relevant to you. Under applicable law, the disclosure of your personal information to these third parties for these purposes may be considered a "sale" of personal information or the processing/sharing of personal information for targeted advertising purposes.

6. ONLINE ANALYTICS AND ADVERTISING

Online Analytics

We and our vendors may use third-party analytics services on the Services to help us understand how users engage with the Services, including Google Analytics. These parties may use cookies and other technologies to help collect, analyze, and provide us with reports and/or data. Online Advertising

We and third parties may use the information we collect to tailor the advertising you see online. You have choices about how information about you is used for this purpose.

Modifying your browser settings or opting out of tailored advertising via your web browser may have different results depending on the type of device or web browser you use and the version of your device operating system. Opting out of tailored advertising does not prevent you from seeing ads online or seeing ads about our Service, but it means the ads you see may not be as tailored to you. Opting out is generally effective only on a device-by-device or browser-by-browser basis. If you use more than one browser or device, the effect of any opt-out mechanism may be limited to the device on which you used the mechanism and you may need to repeat your choices for each browser or device you use.

7. THIRD-PARTY SERVICES

Social Features

Certain features of the Services may permit you to initiate interactions between the Services and third-party services or platforms, such as social networks ("Social Features"). Social Features include features that allow you to click and access Sumble's pages on certain third-party platforms, such as Facebook and Twitter, and from there to "like" or "share" our content on those platforms. Use of Social Features may entail a third party's collection and/or use of your data. If you use Social Features or similar third-party services, information you post or otherwise make accessible may be displayed publicly or to certain other individuals by the third-party service you are using. Both Sumble and the third party may have access to information about you and your use of both the Services and the third-party service.

Other Third-Party Services

The Services may allow you to collect information from or contain links to websites or other online platforms or services operated by third parties and may contain content provided by third parties (together with Social Features, "Third-Party Services"). If you interact with sites or other online services not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not make any representations or guarantees regarding any Third-Party Services and are not responsible in any way for the practices of any third party. Information you provide on public or semi-public venues, including information you disclose on third-party social networking platforms, may be viewable by other individuals. Our inclusion of third-party links does not, by itself, imply any endorsement of the content on such Third-party Services or of their owners or operators. You interact with Third-Party Services at your own risk.

8. CHILDREN'S PRIVACY

Children under the age of 18 are not permitted to use the Services, and we do not seek or knowingly collect any "personal information" (as defined in relevant laws) from children under 18 years of age. If we become aware that we have collected information from a child under 18 years of age, we will make commercially reasonable efforts to delete such information as required by law. If you are the parent or guardian of a child under 18 years of age who has provided us with their personal information, you may contact us using the information below to request that it be deleted.

9. SECURITY AND RETENTION OF YOUR INFORMATION

Although we take certain measures to protect your information, transmitting information electronically carries certain risks and no security measures are perfect. By using the Services, you acknowledge and accept that we cannot guarantee the security of your information and that you provide your information at your own risk. We recommend that you do not use unsecure channels to communicate your information to us.

We may retain your information until we determine that retention no longer is necessary to fulfill the purpose for which it was collected and retained, and as required by applicable law. Retention periods may vary depending on the type of information and the context and purpose of its collection and use.

If you are a California resident, California law requires us to provide you with some additional information regarding how we collect, use, and disclose your "personal information" (as defined in the California Consumer Privacy Act ("CCPA")). Opt Out of Sale/Sharing of Personal Information. The CCPA sets forth certain obligations for businesses that "sell" personal information or "share" personal information for cross-context behavioral advertising purposes. Under the CCPA, "sale" and "sharing" are defined such that they may include allowing third parties to receive certain information for advertising purposes.

If you have a legally recognized browser-based opt out preference signal turned on via your device browser, we recognize the preference expressed by such signal in accordance with applicable law.

To opt out of our disclosure of your personal information other than through cookies and similar technologies for purposes that are considered a "sale" or "sharing" for cross-context behavioral advertising purposes under the CCPA, please send us an email at the email address in the "Contact Us" section below identifying your (1) email address and (2) URL to your LinkedIn profile.

We do not knowingly sell the personal information of minors under 16 years of age.

Additional California Privacy Rights. California residents may make certain requests about their personal information under the CCPA as set forth in the "Your Rights and Choices" section above.

If we ever offer any financial incentives in exchange for your personal information, we will provide you with appropriate information about such incentives.

In the limited circumstances that we process sensitive personal information as defined in the CCPA (e.g., log-in information), we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Shine the Light. California's Shine the Light Law (CA Civil Code ยง 1798.83) allows residents with which a business has an established business relationship to request a list of the third parties to which the business has disclosed certain "personal information" (as specifically defined by the Shine the Light law) during the preceding year where the business knows or reasonably should know that the third parties used the personal information for the third parties' own "direct marketing purposes," defined by the Shine the Light law as the use of personal information to solicit or induce a purchase, rental, lease, or exchange of products, goods, property, or services directly to individuals by means of the mail, telephone, or electronic mail for their personal, family, or household purposes. However, the business is not required to provide this information where the business adopts and discloses, in its privacy policy, a policy of not disclosing "personal information" to third parties for their "direct marketing purposes" 1) unless the resident first affirmatively agrees or 2) if the resident has exercised an option that prevents that information from being disclosed. 11. INFORMATION FOR NON-U.S. RESIDENTS

Please note that Sumble is located in the United States. If you are located outside of the United States, you should be aware that any information you provide to us about yourself is transmitted to us and processed in the United States and other locations where we or our vendors or partners are located. Your information will be protected subject to this Privacy Policy and United States laws, which may not be as protective as the laws in your country. By using the Services, you acknowledge and consent to such transfers of your information to the United States and other locations where we or our vendors or partners are located.
